Terms of Service

1. Description of Service

AeroFSM is a field service management platform: scheduling, dispatch, quoting, customer management, payment collection, and related customer communications (including text messaging) for service businesses ("Tenants") and the technicians they employ.

2. Accounts & Eligibility

You must provide accurate information when creating an account and are responsible for activity that occurs under your account and credentials. AeroFSM is intended for business use by adults authorized to act on behalf of a Tenant.

To keep accounts secure and recoverable, AeroFSM sends account-security communications — password-reset codes and two-factor authentication codes — by email and, where a phone number has been provided and verified, by text message. This applies to a Tenant's admin and to any technician or other user a Tenant invites to their account. This is distinct from the customer-facing text messaging described in Section 4 below: it's sent to your own account holders about their own account, not to a Tenant's customers.

3. Subscriptions, Billing & Payment

AeroFSM subscriptions are billed in advance on a recurring basis through Stripe. By subscribing, you authorize AeroFSM to charge your payment method for the applicable plan until you cancel. Fees are non-refundable except where required by law. You can cancel at any time; cancellation takes effect at the end of the current billing period.

Separately, AeroFSM also facilitates payment collection between a Tenant and that Tenant's own customers for services rendered, also processed through Stripe. AeroFSM is not a party to that underlying service transaction.

4. SMS & Text Messaging Terms

AeroFSM allows Tenants to send transactional text messages to their own customers — appointment reminders and dispatch status updates directly tied to a service the customer has requested. By providing a phone number and consenting to receive these messages from a Tenant, a customer agrees to the following:

• Message frequency varies depending on service activity.
• Message and data rates may apply.
• Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE to any message to opt out at any time; reply HELP for help.
• Reply START to resume messages after opting out.
• Carriers are not liable for delayed or undelivered messages.

5. Acceptable Use

You agree not to use AeroFSM to send unsolicited or unlawful communications, to violate any applicable law or third party's rights, to interfere with the platform's normal operation, or to attempt to access another Tenant's data without authorization.

6. Tenant Data Responsibilities

As between AeroFSM and a Tenant, the Tenant owns the customer information it enters into AeroFSM and is responsible for having a lawful basis — including proper consent — to collect it and to send the communications described in Section 4. AeroFSM processes that information on the Tenant's behalf to provide the service.

7. Intellectual Property

AeroFSM and its licensors retain all rights, title, and interest in the AeroFSM platform, including its software, design, and trademarks. These Terms grant you a limited, non-exclusive, non-transferable right to use AeroFSM for your business's own operations — nothing more.

8. Disclaimers

AeroFSM is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the service will be uninterrupted, error-free, or that every text message will be delivered.

9. Limitation of Liability

To the fullest extent permitted by law, AeroFSM will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the platform. Our total liability for any claim relating to AeroFSM will not exceed the amount you paid us in the twelve months before the claim arose.

10. Indemnification

You agree to indemnify and hold AeroFSM harmless from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any applicable law or third party's rights — including claims arising from communications you send through AeroFSM.

11. Termination

You may stop using AeroFSM and cancel your subscription at any time. We may suspend or terminate access to AeroFSM if these Terms are violated, or if we discontinue the service, with notice where practicable.

12. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify Tenants directly.
